Glossary / AOH

AOH

Common abbreviation for Affidavit of Heirship.

See: Affidavit of Heirship. The most common curative document in Texas mineral title, used to establish the family tree and inheritance shares for a decedent who died without recorded probate.

AOH usage in title opinions: a Texas AOH is presumed prima facie evidence of the facts stated after it has been on file for five years, per Texas Estates Code § 203.001. Title attorneys often accept newer AOHs (less than 5 years) as part of a curative package, especially when supported by a death certificate and corroborating evidence, but the five-year rule changes the evidentiary weight.
